Possession Limits
- Recreational: 1oz flower, 8g concentrates, 800mg THC edibles
- Medical (Red Card): 2oz (up to 8oz with physician recommendation)
Medical Card (Red Card)
Qualifying conditions: Cancer, glaucoma, HIV/AIDS, severe pain, severe nausea, seizures, muscle spasms, PTSD, autism, plus any condition where a physician would prescribe an opioid.
Cost: $52 state fee + $100-400 physician. Fee waivers at 185% federal poverty level.
Renewal: Annual. Processed in 1-3 business days.
Home Cultivation
6 plants per person (max 3 mature/flowering at any time). Locked, enclosed space not visible from public areas.
Consumption Lounges
Licensed since January 2020 in opt-in jurisdictions. No alcohol or food sold. Edibles permitted. Must be 21+.
DUI / Impairment
5 ng/mL in blood creates a “permissible inference” of impairment. Not automatic conviction, but very difficult to overcome. Frequent users can test above 5 ng/mL when completely sober.
Employment Protections
Bill passed prohibiting employer adverse action for off-duty use. Effective August 12, 2026. Until that date, employers can still enforce zero-tolerance policies.
What Most People Get Wrong
People think the 5 ng/mL blood limit works like 0.08 BAC for alcohol. It does NOT. You CAN still be charged at LOWER levels if impairment is demonstrated. Daily medical patients may test above 5 ng/mL even when completely sober.
