Home Cultivation
Up to 12 plants per HOUSEHOLD (not per person). Must be locked, enclosed, invisible from public. Medical caregivers: up to 12 plants per patient.
DUI / Impairment
Technically zero tolerance (any detectable THC). However, Michigan Supreme Court ruled the state must demonstrate actual impairment. Mere presence of THC is insufficient for conviction.
New Taxes (2026)
24% wholesale excise tax on recreational transfers to retailers (January 2026), on top of existing 10% retail excise tax and standard sales tax.
What Most People Get Wrong
People assume the 12-plant home grow limit is per person. It is per HOUSEHOLD. Two adults living together still share the 12-plant cap. And plants must be locked and enclosed. Growing openly in a backyard is illegal regardless of plant count.
